One, she didn't even know he had the toy gun. He had exchanged his phone for the gun with one of his friend for the day precisely because him mom wouldn't let him have toy guns.
Two, he was at a park not "around town."
Three, kids have been playing with toy guns outside since toy guns came into existence. Even if she did let him play with it, why would she have the expectation that he'd be killed over it? -
