    The three Orthodox Jewish men accused of brutally beating a ? black man and leaving him partially blind will likely not serve prison time under an expected plea deal, the Daily News has learned.

    The case largely crumbled once at least two witnesses to the December 2013 beatdown changed their version of events after initially implicating the members of the Shomrim volunteer Jewish security patrol, sources said.

    Also, surveillance video from the Williamsburg, Brooklyn, scene is limited, people familiar with the case told The News.

    Taj Patterson, 25, was walking down Flushing Ave. in Williamsburg in December 2013 when he was set upon by a gang of men shouting anti-? slurs, prosecutors said. Patterson suffered severe injuries including a broken eye socket and a torn retina that has left him permanently blind in one eye.

    Patterson's lawyer charged members of the insular Hasidic community pressed the witnesses to recant.

    "The Shomrim claim they are committed to justice, yet they shut down witnesses with an efficiency the mafia would envy," said Patterson's lawyer, Andrew Stoll. "They banish and shun any member of their community who dares to come forward."

    The three defendants are Abraham Winkler, 40, Mayer Herskovic, 22, and Pinchas Braver, 20.

    Two of the accused men will accept a misdemeanor charge while the other will admit to a felony offense at their next court date, sources said. None will face jail time under the agreement negotiated by prosecutors for Brooklyn District Attorney Ken Thompson, according to sources.

    The DA's office declined to comment on the plea negotiations. The men's lawyers did not reply to requests seeking comment.

    But the idea that this erases all the other good that he has done is just stupid, perhaps even evil.

    Started listening to this. What he is saying is confused.

    He says that after prosecuting Laing and in effect claiming that the shooting was no accident, he turned around and claimed that the shooting was an accident when he recommended no jail time.

    This is confused because just because he prosecuted him doesn't mean that he didn't believe it was an accident. A person can be criminally liable for an accident. I believe they would call it culpable negligence.

    He also claimed that he was bought off by Asians. What's the evidence of that? That is a pretty serious allegation.

    You do realize that after Liang shot and killed Gurley his first call was to his union rep and not 911 for an ambulance dont you? If im not mistaken the person who was with Gurley performed cpr on him while Liang was talking to his union rep. After shooting him Liang didn't even try to save his life. He was more concerned with saving his own ass.

    The cover story that Liang is a victim of accidental circumstance that were all beyond his control is total ? . That pig had no reason to pull his firearm let alone fire the shot that struck and killed an innocent unarmed man. Every preventable and unnecessary act that led to Akai Gurley's death was committed by Peter Liang. Gurley did nothing to provoke his murder and there was nothing he could do to save his own life that was senselessly and unnecesarily taken by the careless and reckless acts of officer Liang.

    Thats why that son of a ? was CONVICTED of manslaughter and official misconduct and was facing up to 15 years. That uncle tom, ? , ? ass Ken Thompson knew all of this, looked Akai Gurley's family in their eyes and requested that Peter Liang get no jail time. ? Ken Thompson.     The three Orthodox Jewish men accused of brutally beating a ? black man and leaving him partially blind will likely not serve prison time under an expected plea deal, the Daily News has learned.

    The case largely crumbled once at least two witnesses to the December 2013 beatdown changed their version of events after initially implicating the members of the Shomrim volunteer Jewish security patrol, sources said.

    Also, surveillance video from the Williamsburg, Brooklyn, scene is limited, people familiar with the case told The News.

    Taj Patterson, 25, was walking down Flushing Ave. in Williamsburg in December 2013 when he was set upon by a gang of men shouting anti-? slurs, prosecutors said. Patterson suffered severe injuries including a broken eye socket and a torn retina that has left him permanently blind in one eye.

    Patterson's lawyer charged members of the insular Hasidic community pressed the witnesses to recant.

    "The Shomrim claim they are committed to justice, yet they shut down witnesses with an efficiency the mafia would envy," said Patterson's lawyer, Andrew Stoll. "They banish and shun any member of their community who dares to come forward."

    The three defendants are Abraham Winkler, 40, Mayer Herskovic, 22, and Pinchas Braver, 20.

    Two of the accused men will accept a misdemeanor charge while the other will admit to a felony offense at their next court date, sources said. None will face jail time under the agreement negotiated by prosecutors for Brooklyn District Attorney Ken Thompson, according to sources.

    The DA's office declined to comment on the plea negotiations. The men's lawyers did not reply to requests seeking comment.

    On Monday, the case was adjourned for the 14th time, court records show.


    Initially, five men were arrested for their alleged role in the early morning attack on Dec. 1, 2013.

    "It was a very serious crime with incredibly serious injuries caused to the victim," Police Commissioner Bill Bratton told reporters at the time.

    But prosecutors dropped charges against one of the alleged assailants, Joseph Fried, 27, last December. That came after a second defendant, Aharon Hollender, 29, also had his case dismissed last March.

    The case was almost closed from the outset due to pressure from the Orthodox community, the News reported earlier this month.

    Cops from the 90th Precinct initially classified the attack as a misdemeanor and inexplicably marked the complaint "closed" despite several witnesses.

    It only got reopened after the Patterson's mother vociferously complained and got media coverage on the case.


    Police maintain the case was brought back to life after a crime analyst noticed it was prematurely closed.

    As for the planned plea deal, one community activist predicted it would have damaging consequences.

    "The fact that no one is going to get jail time because of this is alarming," said activist Tony Herbert. "It will have serious ramifications throughout the community, particularly the African-American community."

    I agree that the Peter Liang decision was a mistake.

    But the idea that this erases all the other good that he has done is just stupid, perhaps even evil.

    You do realize that after Liang shot and killed Gurley his first call was to his union rep and not 911 for an ambulance dont you? If im not mistaken the person who was with Gurley performed cpr on him while Liang was talking to his union rep. After shooting him Liang didn't even try to save his life. He was more concerned with saving his own ass.

    The cover story that Liang is a victim of accidental circumstance that were all beyond his control is total ? . That pig had no reason to pull his firearm let alone fire the shot that struck and killed an innocent unarmed man. Every preventable and unnecessary act that led to Akai Gurley's death was committed by Peter Liang. Gurley did nothing to provoke his murder and there was nothing he could do to save his own life that was senselessly and unnecesarily taken by the careless and reckless acts of officer Liang.

    Thats why that son of a ? was CONVICTED of manslaughter and official misconduct and was facing up to 15 years.     Look man, I don't agree with the sentencing of Peter Liang. That case was a little difficult because it was an accident. I still think he should've got jail time for 5 years or so. Ken Thompson said he wanted justice and not revenge. Its still not good enough but I understand where he's coming from. He showed the power of will to forgive which apparently many of y'all don't understand. He prosecuted one of the Jewish guys that assaulted Taj Patterson. The others took plea bargains before he could even prosecute but it's still not good enough.

    Ken Thompson is not a sell out, traitor, uncle tom or a ? . Y'all use these terms too loosely. For every person that speaks bad about Ken, there's a lot more people that he helped that will speak good about him. Would you call Abner Louima an apologist? What about David McCallum? An innocent man black man wrongfully accused for a murder he didn't commit. Dude was in prison for 29 years and spoke highly for Ken Thompson who helped freed him. What about Emmet Till's family? Are they apologists? I wouldn't mind being in the company of apologist to those he helped.

    People don't get locked up and just say "I'm accepting a plea bargin" without the prosecutor offering one first.

    You're right about the plea bargain stuff but I don't agree with Ken Thompson not wanting to prosecute. I'm not saying that all of his positives in public should be nullified for his negatives. I just think that it is unfair to forget about them. I would've been fine if some said they don't like how Ken handled this situation but still fought for and helped a lot of people. Saying stuff like rest in ? and other slander made me think that it is unfair because he didn't deserve that yo.
